Miller Stratvert P.A. attorneys Rick Alvidrez and Robert Clark achieved significant success after extensive briefing and an 8-day hearing in December of 2011 in front of the New Mexico Environmental Improvement Board. In late 2010, the Board had adopted a Greenhouse Gas Reduction Program. On March 16, 2012, the Board acted favorably on a petition filed by MSPA clients Public Service Company of New Mexico and Southwestern Public Service Company to repeal the Greenhouse Gas Reduction Program. The Board voted unanimously (5-0) to repeal the regulation based on evidence that it would have imposed significant costs on the State of New Mexico and its citizens and industry, while achieving little in the way of environmental or health benefits.
